Terms of Service

These terms cover services sold by Named First, a Borough Web Works company based in Ontario, Canada (“we”, “us”), to you, the business buying them (“you”).

Services and prices

• Visibility Audit: $199 CAD plus HST, one-time. A dated report on whether AI assistants and Google AI name your business, what they say, where it comes from and who is named instead, plus a short call to walk you through it.
• Fix-It Setup: $499 CAD plus HST, one-time. We carry out the fixes listed in your audit, then re-check and send a dated before and after.
• Monthly Visibility: $249 CAD plus HST per month. Month-to-month with no minimum term.

All prices are in Canadian dollars and do not include HST, which is added at checkout or on your invoice.

Payment

• Visibility Audit: paid in full before we start, either through our secure Stripe checkout or by invoice.
• Fix-It Setup: invoiced once you confirm you want to go ahead, and paid in full before work starts. Invoices are due on receipt.
• Monthly Visibility: billed in advance through Stripe on the same date each month, starting the day you sign up, until you cancel.

Card payments are processed by Stripe. We never see or store your full card number.

If a Monthly payment fails, Stripe will try again and we'll let you know. If it's still unpaid after 14 days, we pause the work until it's paid.

The audit credit

If you start Fix-It Setup within 30 days of the date on your audit report, the $199 you paid for the audit comes off the $499, so you pay $300 plus HST. The credit can only be used toward Fix-It Setup. It has no cash value and can't be refunded on its own.

No guaranteed results

We don't control ChatGPT, Gemini, Claude, Perplexity, Google or any other service, and their answers change. We do the work described and report results honestly with dates, but we can't guarantee that any assistant will name your business, rank it in a certain position or describe it in a certain way. Refunds are based on the work we've done, not on what AI assistants say afterwards.

Refunds

Visibility Audit

• Before we start: a full refund. Just email us.
• After we start: no refund, because the checks have been run. Once you have your report, if something in it is wrong, tell us within 14 days and we'll correct it at no charge.
• If we can't deliver it: if we can't complete your audit for any reason on our side, we refund it in full.

Fix-It Setup

• Before work starts: a full refund of what you paid.
• After work starts: we refund the share of what you paid that covers fixes on your list we haven't started. Fixes already done or in progress aren't refundable.

Monthly Visibility

• No refunds for a month that has already started, including part months after you cancel.
• If we end the service ourselves, we refund any month you've paid for but haven't started.

Approved refunds go back to the original payment method, including the HST paid on that amount. They usually show up within 5 to 10 business days, depending on your bank.

Cancelling

• Monthly Visibility: cancel anytime by emailing thuva@namedfirst.boroughwebworks.ca. There's no notice period and no cancellation fee. Your service continues to the end of the month you've paid for, and you won't be billed again.
• Visibility Audit and Fix-It Setup: cancel by email at any time. The refund rules above apply.
• If we need to end the service: we'll give you at least 30 days' notice by email, unless a bill is unpaid or the work would break the law or a platform's rules.

Disputes and chargebacks

If you're unhappy with a charge, please email us first. We'll reply within two business days and try to sort it out before you contact your bank.

Your part

For Fix-It Setup and Monthly Visibility you may need to give us access to listings or your website, and confirm business details. You're responsible for the accuracy of what you tell us. We'll only use access for the work you've asked for.

Liability

To the extent the law allows, our total liability for any claim is limited to the fees you paid us for the service in question in the three months before the claim.

Governing law

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there.
